Notice that the Trump administration did not return Abrego Garcia -  despite a court order to do so - to the US until they decided to charge him with an illegal immigration offense. Until then, they said it was impossible. Riiiiight...

I suspect this is a poorly thought out attempt to justify the initial deportation, and arrange to deport him again.

Them:
"Look! See, he was guilty of something! We were right!"

The courts:
"He wasn't even *accused* of anything when you deported him. And he *still* isn't guilty of anything."
